OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:  On or about November 21, 2016 at a job site located at 419 Fair St, Berea, Ohio 44017; an employee was exposed to a fall hazard of approximately 12 to 15 feet while using the bucket of a John Deer 160G Excavator, as a means of access and or egress from a 13.6 feet deep trench.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c).    On or about November 21, 2016, at a job-site located at 419 Fair St, Berea, Ohio 44017; the employer did not ensure adequate cave-in protection was used to protect an employee working inside a trench with near vertical side walls and a depth varying from approximately 12 to 13.6 feet.  The trench was determined to have type "C" soil which was classified by the on-site foreman.
