29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equaled or exceeded an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    The employer did not administer a hearing conservation program for employees exposed to noise that exceeded an 8-hour time-weighted average (TWA) of 85 dBA, based on an 80 dB threshold.     (a) In the processing room, a raw product worker was exposed to continuous noise levels at 98.68% of the permissible 8-hour TWA (90 dBA).  The equivalent dBA level of 98.68% is approximately 89.9 dBA.  Sampling was performed for 473 minutes during one shift.  Zero exposure was assumed for the unsampled period of 7 minutes.    (b) In processing room, a grade table worker was exposed to continuous noise levels at 82.83% of the permissible 8-hour TWA (90 dBA).  The equivalent dBA level of 82.83% is approximately 88.6 dBA.  Sampling was performed for 468 minutes during one shift.  Zero exposure was assumed for the unsampled period of 12 minutes.    (c) In the processing room, a high care worker was exposed to continuous noise levels at 79.44% of the permissible 8-hour TWA (90 dBA).  The equivalent dBA level of 79.44% is approximately 88.3 dBA.  Sampling was performed for 469 minutes during one shift.  Zero exposure was assumed for the unsampled period of 11 minutes.    (d) In the processing room, a low care worker was exposed to continuous noise levels at 81.29% of the permissible 8-hour TWA (90 dBA).  The equivalent dBA level of 81.29% is approximately 88.5 dBA.  Sampling was performed for 463 minutes during one shift.  Zero exposure was assumed for the unsampled period of 17 minutes.
