29 CFR 1910.147(c)(1): Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.    The employer did not establish an energy control program consisting of energy control procedures, employee training, and periodic inspections when employees were performing servicing and maintenance work on equipment covered by this section such as the Heartland Fabrication & Machine Inc. Model B54D bandsaw dismantler and Trace Equipment Corporation Model EN10 notching machine.

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.    (a)  On or about February 23, 2017, employees were exposed to the point of operation of the Heartland Fabrication & Machine Inc. when dismantling pallets located in the breakdown area.     (b)  On or about February 23, 2017, employees were exposed to the point of operation created between the hydraulic ram and attachment plate on the plate bender located in the assembly area.

29 CFR 1910.213(g)(1): Each swing cutoff saw shall be provided with a hood that will completely enclose the upper half of the saw, the arbor end, and the point of operation at all positions of the saw. The hood shall be constructed in such a manner and of such material that it will protect the operator from flying splinters and broken saw teeth. Its hood shall be so designed that it will automatically cover the lower portion of the blade, so that when the saw is returned to the back of the table the hood will rise on top of the fence, and when the saw is moved forward the hood will drop on top of and remain in contact with the table or material being cut.    On or about February 23, 2017, the hood provided on the Universal Machinery Sales, Inc. manual chop saw did not guard the point of operation at the top position of the saw as the blade was exposed through an approximate three inch opening.

On or about February 23, 2017, employees were exposed to the point of operation of a Trace Equipment Corporation notcher model EN10 as the guard did not prevent employee access.

29 CFR 1910.178(l)(6): Certification. The employer shall certify that each operator has been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation.  On or about February 23, 2017, the employer did not certify training performed for forklift operators.
