29 CFR 1918.105(b)(1): The employer did not require the wearing of PFDs for each employee engaged in work in which the employee might have fallen into the water. (a) Barge Columbia Newark, Port Side: On or about March 6, 2017 and at times prior thereto, where fall protection was not provided, an employee was working on the leading edge of the barge was not wearing a PFD. This condition exposed employees to fall and drowning hazards.

29 CFR 1918.65(h)(9): When lift trucks or other mechanically powered vehicles were being operated on open deck-type barges, the edges of the barges were not guarded by railings, sideboards, timbers or other means sufficient to prevent vehicles from rolling overboard: Barge Columbia Newark: On or about March 6, 2017 and at times prior thereto, an employee operating a "Big Red" forklift, equipment number SLT933, on the open deck-type barge was not protected from rolling overboard. This condition exposed the employee to drowning hazards. Samson Tug & Barge, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 990225, citation number 1, item number 5 and was affirmed as a final order on 09/30/2014, with respect to a workplace located at Kodiak, Alaska.
