29 CFR 1918.32(b): The edge of a hatch section, or of stowed cargo, was not guarded by a vertical safety net or other means providing equal fall protection to exposed employees. (a) M/V Chilean Reefer, Hatch 4A: On or about March 6, 2017 and times prior thereto, the intermediate deck had an open side on the starboard side of the tween deck. This condition exposed employees to an 8 foot fall hazard. (b) M/V Chilean Reefer, Hatch 4A: On or about March 6, 2017 and times prior thereto, intermediate decks had an open hatch adjacent to the fixed ladder landings. This condition exposed employees to an 8 foot fall hazard. (c) M/V Chilean Reefer, Hatch 3C: On or about March 6, 2017 and times prior thereto, intermediate decks had an open hatch adjacent to the fixed ladder landings. This condition exposed employees to an 8 foot fall hazard.

29 CFR 1918.62(b)(3)(ii): Wire rope or wire rope slings having kinking, crushing, bird caging, or other damage resulting in distortion of the wire rope structure were used: (a) M/V Chilean Reefer, Hatch 3C: On or about March 6, 2017 and at times prior thereto, lifting bridle for the 8100 kg SWL lifting bell was kinked. This condition exposed employees to struck-by hazards in the event of bridle failure. (b) M/V Chilean Reefer, Hatch 4A: On or about March 6, 2017 and at times prior thereto, lifting bridle for the 8100 kg SWL lifting bell was kinked. This condition exposed employees to struck-by hazards in the event of bridle failure.

29 CFR 1918.62(g)(2)(iii): Synthetic web slings were not removed from service when they exhibited snags, punctures, tears, or cuts: (a) M/V Chilean Reefer, Hatch 4A: On or about March 6, 2017 and at times prior thereto, web lifting sling used to deliver the CAT Forklift CE13 to the hatch was cut and torn in multiple locations. This condition exposed employees to struck-by hazards in the event of sling failure. (b) M/V Chilean Reefer, Hatch 4A: On or about March 6, 2017 and at times prior thereto, web lifting sling used to deliver the CAT Forklift CE16 to the hatch was cut and torn in multiple locations. This condition exposed employees to struck-by hazards in the event of sling failure.

29 CFR 1918.61(a): Cargo handling gear and equipment provided by the employer was not inspected by the employer or the designated person before each use, and/or at appropriate intervals during its use to ensure that it was safe: M/V Chilean Reefer, Hatch 4A: On or about March 6. 2017 and at times prior thereto, a leg of the 8100 kg SWL lifting bell in use was bent off vertical and showed impact damage. This condition exposed employees to struck-by hazards in the event of failure.
