29 CFR 1910.146(c)(4): If the employer decides that its employees will enter permit spaces, the employer shall develop and implement a written permit space program that complies with this section. The written program shall be available for inspection by employees and their authorized representatives.  On or about March 15, 2017, the employer had not developed and implemented a written permit space program to comply with 29 CFR 1910.146. Employees entered permit required confined spaces, to include the mixers, for the performance of maintenance and equipment inspection.

29 CFR 1910.146(c)(2): If the workplace contains permit spaces, the employer shall inform exposed employees, by posting danger signs or by any other equally effective means, of the existence and location of and the danger posed by the permit spaces.  NOTE: A sign reading DANGER -- PERMIT-REQUIRED CONFINED SPACE, DO NOT ENTER or using other similar language would satisfy the requirement for a sign.  On or about March 15, 2017, the employer had not posted adequate danger signs on permit-required spaces, such as mixers. During mixer entry, employees were exposed to potential engulfment, mechanical and fall hazards.

The employer shall provide training so that all employees whose work is regulated by this section acquire the understanding, knowledge, and skills necessary for the safe performance of the duties assigned under this section.  On or about March 15, 2017, the employer failed to provide training for the safe performance of duties for employees assigned to work in permit-required confined spaces. Maintenance employees entered mixers to perform maintenance activities and equipment inspection. During mixer entry, employees had exposure to potential engulfment, fall and mechanical hazards.

29 CFR 1910.147(c)(4): General - Energy control procedure.  29 CFR 1910.147(c)(4)(i): Procedures shall be developed, documented and utilized for the control of potentially hazardous energy when employees are engaged in the activities covered by this section.  On or about March 15, 2017, the employer had not developed, documented and utilized specific procedures for control of hazardous energy during servicing and maintenance activities. Employees performed maintenance and servicing activities covered by this part without the benefit of specific procedures for equipment, such as but not limited to the incline conveyor and the mixers.
