29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.    On or about January 25, 2017, employee ascending or descending an extension ladder while performing plumbing activities was exposed to fall hazards when the extension ladder railing was not 3 feet above the attic.

The employer failed to train employees on the proper construction, use and placement of ladders exposing the employees to a fall hazard.

29 CFR 1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours.    The employer failed to report to OSHA a work-related hospitalization, a hospitalization occurred on January 25, 2017 and was not reported to OSHA until January 30, 2017.
