The most recent occurrence of this was evident during the inspection at the job site located one block east of 7th Street on Madison Ave in Norfolk, NE where the employer has employees working in a trench where the depth is greater than 5 feet, without protection while installing a new water main; in this incident employees are cutting out old water pipe at the base of the 6-7 foot vertical east wall.

29 CFR 1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours:   On or about March 20, 2017, the employer failed to report to OSHA an in-patient hospitalization of on an employee. The employer has failed to report an in-patient hospitalization to OSHA within 24 hours.  This most recent occurrence of this took place at the job site located one block east of 7th Street on Madison Ave in Norfolk, NE  where on March 20, 2017 the employer had an employee working at the base of a 7 foot vertical wall in a trench; before the superintendent could exit the trench the vertical wall collapsed on him burring him from mid-thigh down, fracturing his pelvis.  The superintendent was taken to a hospital where they received in-patient treatment as well as kept overnight for observation and continuous treatment.  The employer did not report the incident to OSHA until March 28, 2017.
