Employers shall base the selection of the appropriate hand protection on an evaluation of the performance characteristics of the hand protection relative to the task(s) to be performed, conditions present, duration of use, and the hazards and potential hazards identified. On or about April 15, 2017, the employer did not ensure adequate hand protection was used to protect employees from struck-by hazards when exposed to metal pipe impact while performing manual unloading operations at the customer yard.

29 CFR 1904.39(a)(2): Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA. On or about March 14, 2017, the employer failed to report the in-patient hospitalization of an employee from a work-related injury within 24 hours to the nearest OSHA area office.
