29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a.) On or about April 27, 2017, the employer failed to implement a hearing conservation program to control employees exposure to occupational noise. An employee working with the hand pneumatic grinder was exposed to noise at an 8 hour time weighted average of 87.3 dBA, which exceeded the OSHA action limit of 85 dBA. b.) On or about April 27, 2017, the employer failed to implement a hearing conservation program to control employees exposure to occupational noise. An employee working with the hand pneumatic grinder was exposed to noise at an 8 hour time weighted average of 88.7 dBA, which exceeded the OSHA action limit of 85 dBA.

29 CFR 1910.1200(g)(8): The employer did not ensure that Safety Data Sheets were readily accessible during each work shift to employees when they were in their work area(s) a.) On or about April 13, 2017 the employer did not have safety data sheets readily accessible to all employees working in the facility. Employees working in the facility were exposed to degreasers and lubricants containing hazardous materials including but not limited to acetone and petroleum distillates.
