OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to it's employees: a) On or about May 30, 2017 at Substation #7, Beach Avenue, Rochester, NY as part of the inspection and testing of the circuit breaker for capacitors 1R7402 and 1R7412 (an atypical configuration for this type of equipment within the employer's system), the employer did not provide adequate training as to the configuration of the electric feed to capacitors 1R7402 and 1R7412, so as to assist employees in recognizing the hazards of entering an adjacent cabinet without first arranging for the de-energizing of the adjacent cabinet.

29 CFR 1910.269(c)(4)(ii)(B): The employee could not be expected to recognize and avoid the hazards involved in the job and a more extensive briefing was not held; a) On or about 05/30/18 at Substation #7, Beach Avenue, Rochester, NY; the inspection and testing of circuit breakers for capacitors 1R7402 and 1R7412, located in metal cabinets and connected to underground energized conductors (an atypical configuration for this type of equipment within the system), did not necessitate the employer to require a more extensive job briefing (tail board) to include the hazards associated this type of circuit breaker configuration and the hazards of associated with accessing the north side of the cabinets, i.e. the presence of energized conductors (11kV) and the use of protective measures such as but not limited to, voltage testing, installation of protective covers, additional personal protective equipment, confirmation of the line diagram review. ABATEMENT DOCUMENTATION REQUIRED

ABATEMENT DOCUMENTATION REQUIRED
