OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and burn hazards: a) On May 28, 2017, a manager suffered struck-by and burn injuries and an employee suffered burn injuries when a lid violently released pressure build-up from a fryer cooker. A new, inadequately trained employee incorrectly installed the lid of a CollectraMatic fryer cooker with Model number PF56C11SJ1 and Serial Number 20070724-030 prior to cooking a batch of chickens. The employee installed the metal plate of the lid on top of its pressure relief valve, preventing the valve to open and release the pressure and caused the lid to malfunction in operation. One manager tried to force the lid open with a hammer. The lid of the fryer cooker released violently and struck the manager on the head and also suffered second to third degree burn injuries from the hot cooking oil. Another employee standing nearby also suffered a burn injury on his hand. One feasible and acceptable methods to correct these hazardous conditions would be to provide adequate supervision to ensure employees understand proper procedures on the installation and removal of the lid of the CollectraMatic fryer cooker, and have a trained servicer repair the cooker as required by the manufacturer's instruction manual when needed.
