29 CFR 1910.95(c)(1): A continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (n) was not instituted when employee noise exposures equaled or exceeded an 8 hour time weighted average sound level (TWA) of 85 dBA:  a)  At the Shaker House, on or about July 7, 2017 - A continuing effective hearing conservation program was not instituted when employee noise exposures equaled or exceeded an 8 hour time weighted average of 85 dBA.  An employee, designated as a laborer, had an exposure to continuous noise at a dose of 86.1%.  The exposure is approximately 1.72 times the OSHA action level of 85 dBA. 29 CFR 1910.134(e)(6): 29 CFR 1910.134(e)(6):  In determining the employee's ability to use a respirator, the employer shall obtain a written recommendation regarding the employee's ability to use the respirator from the PLHCP (physician or other licensed health care professional):  a)    At the Shaker House, on or about June 16, 2017 - Employees, who voluntarily wear a respirator, were not provided with medical evaluation prior to donning a respirator.  Employees voluntarily wear a Safety First half mask respirator when conducting unloading operations.
