29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, were not protected by protective helmets. On or about 21 June 2017, an employee was working on the second floor of a residential home under construction without a protective hard hat while another employee was simultaneously working an open roof directly above him conducting roofing activities with wooden boards and a pneumatic nail gun exposing the employee on the ground floor to struck by hazards caused by objects falling from above.

29 CFR 1926.501(b)(13): Employees engaged in residential construction activities 6 feet (1.8m) or more above the lower levels were not protected by guardrail systems, safety net systems, or personal fall arrest systems. On or about 21 June 2017, an employee was conducting roofing activities on the roof of a residential home under construction at heights of up to 20 feet without the use of fall protection, exposing the employee to a fall hazard.
