29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    a) Gun Hub Inc. on or about July 26, 2017, the employer did not develop an effective hearing conservation program for employees, working as Range Safety Officers on the gun range, who were exposed occupational noise at a time weighted average of 95.2 decibels on the 80 threshold and a time weighted average of 95.1 decibels on the 90 threshold. Exposure to occupational noise greater than 85 decibels can cause permanent hearing loss.
