29 CFR 1926.451(c)(2)(v): Fork-lifts shall not be used to support scaffold platforms unless the entire platform is attached to the fork and the fork-lift is not moved horizontally while the platform is occupied. On August 7, 2017, outside the warehouse bathrooms, a forklift operator did not ensure the work platform was attached to prevent the platform from coming off the forks with the employee in the work platform and when going around a corner the platform tipped over and the employee's hand got caught between the metal frame and ground causing an amputation to the first digit of the right middle finger.

The employer had not ensured that an inspection was completed by a competent person to ensure the work platform was properly attached to the forklift and to ensure the work platform meets guardrail requirements when on August 7, 2017 a sit-down forklift with an employee in the work platform tipped over while turning the corner outside the warehouse bathrooms.

29 CFR 1926.451(g)(4)(iii): When midrails, screens, mesh, intermediate vertical members, solid panels, or equivalent structural members are used, they shall be installed between the top edge of the guardrail system and the scaffold platform. On August 7, 2017, in the Refrigeration Room, the employee in the metal work platform used by the forklift operator was exposed to a 25 ft. fall hazard due to the lack of a midrail and/or sufficient vertical members to reduce the gap to less than 19 inches.
