OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were potentially exposed to an oxygen deficient associated with nitrogen:    a. On or about August 18, 2017, in the cookie freezer area, employees were exposed to the hazards of an asphyxyant gas when  operating a horizontal tunnel freezer that used nitrogen for refrigeration.  The cookie freezer are was not equipped with an appropriate gas detection and alarm system to warn employees of a  release of nitrogen (which would lower the oxygen level below 19.5%).      In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is completed must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase and/or repair of gas detection equipment and purchase of appropriate alarm systems.

American Blue Ribbon Holdings, L.L.C., dba Legendary Baking was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1910.212(a)(3)(ii), which was contained in OSHA inspection number 1098120, citation number 1, item number 5 and was affirmed as a final order on March 23, 2016, with respect to a workplace located at 16425 S. Kilbourn, Oak Forest, IL.
