29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees. a) On or about September 19, 2017 and at times thereto, the employer did not ensure the use of an appropriate ladder and/or other safe means of egress while employees were working to repair a sewer line in a trench at a depth ranging from 12.0-14.0 feet. Employees jumped in and climbed the walls as ingress/egress from the work location. Abatement certification AND documentation are required for this item.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. Inspections were not conducted by the competent person prior to the start of work and as needed throughout the shift. a) On or about September 19, 2017, and at times prior thereto, the employer did not ensure a "competent person" was available to inspect the trench prior to the start of work and as needed throughout the shift. Employees were working to repair a sewer line in a trench at a depth ranging from 12.0 to 14.0 feet. Employees did not have the protection of sloping, benching and/or other engineering controls such as an appropriate trench box throughout the sewer repair. Abatement certification AND documentation are required for this item.
