29 CFR 1904.39(a)(2): Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA.  On 4 October 2017 at approximately 11:30 AM, an employee with the company struck his head against a Hitachi Compact Excavator 35U bucket while wearing head protection, suffering an injury to the back right side of his head. The employee complained later in the day of not feeling well with nausea, vomiting and headaches. On 5 October 2017, the employee was found in a hotel room laying on the floor with severe head pain and a loss of balance. The employee was transported by ambulance to the Seton Highland Lakes Hospital where he was admitted and has remained in a hospital since, requiring surgeries and being placed in the Intensive Care Unit (ICU). The hospitalization was not reported within 24 hours to the local Area Office of the Occupational Safety and Health Administration. The Austin Area Office was notified of the incident on 19 October 2017 at approximately 11:30 AM, or 15 days later.
