OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to collapse and struck-by hazards caused by damaged pallet rack systems:    (a)  On or about November 21, 2017, the metal storage racks E17 and E18 located in the Pre-Hung Warehouse were being loaded with product for short term storage.  Employee that worked in that area were exposed to struck by hazards associated with potential storage rack collapse because damaged upright column and diagonal strut on a metal racking system were not isolated from use, unloaded, repaired, and/or replaced once damage was identified.    (b)  On or about November 21, 2017, the racking system did not have the capacity of the system posted exposing employees to struck by hazards from overloading the racking system.

29 CFR 1910.107(b)(5)(i): The spraying operations except electrostatic spraying operations shall be so designed, installed and maintained that the average air velocity over the open face of the booth (or booth cross section during spraying operations) shall be not less than 100 linear feet per minute. Electrostatic spraying operations may be conducted with an air velocity over the open face of the booth of not less than 60 linear feet per minute, or more, depending on the volume of the finishing material being applied and its flammability and explosion characteristics. Visible gauges or audible alarm or pressure activated devices shall be installed to indicate or insure that the required air velocity is maintained. Filter rolls shall be inspected to insure proper replacement of filter media.    On or about November 21, 2018, Paint Booth 1 maintained on average the air velocity of 30.667 linear feet per minute.
