29 CFR 1926.651(j)(2):  Employees were not protected by placing and keeping excavated or other materials or equipment at least 2 feet from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:    (a)  Fortuis Construction, LLC @ 68-78 Brook Trout, Gypsum, CO 81637:  On or before November 14, 2017, as part of injury/accident prevention responsibilities under its safety program, the controlling, creating, and exposing employer did not ensure that adequate excavation safety protection was provided.  A spoil pile containing sizable rocks was not kept at least 2 feet from the edge of the excavation, on the northwest corner of the house foundation.  This excavation was approximately 4 feet 6 inches deep.  This condition exposed employees to the hazard of being struck by the spoil pile rocks.
