29 CFR 1910.28(b)(12)(i): Each employee on a scaffold was not protected from falling in accordance with 29 CFR Part 1926, Subpart L:    a)  Signature Rattan LLC 8356 Syracuse Street, Commerce City, CO 80022:  On and before November 29, 2017 the employer did not ensure that each employee working on a scaffold was protected from falling in accordance with 29 CFR Part 1926, Subpart L.  Employees worked on a MetalTech mobile scaffold platform with unprotected sides or edges that was approximately 10 feet high.  This scaffold had no guardrails lengthwise on both sides.  Personal fall arrest systems, when used, were not designed, installed, and used as a part of a complete personal fall arrest system which maintains a safety factor of two, and were not rigged such that employees could neither free fall more than 6 feet, nor contact the lower level.  This condition exposed employees to fall hazards of approximately 10 feet.    b)  Signature Rattan LLC 8356 Syracuse Street, Commerce City, CO 80022:  On and before November 29, 2017 the employer did not ensure that each employee working on pallets raised by the Hyster H60C forklift was protected from falling in accordance with 29 CFR Part 1926, Subpart L.  The pallet platforms used to elevate employees were not designed by a qualified person to be used as mobile scaffolds with this forklift.  This condition exposed employees to fall hazards of up to approximately 20 feet.

29 CFR 1910.28(b)(3)(i): The employer did not ensure each employee was protected from falling through any hole (including skylights) that is 4 feet or more above a lower level by one or more of the following: covers, guardrail systems, travel restraint systems, or personal fall arrest systems, as required by sub-items A through D of this section:  a)  Signature Rattan LLC at 8356 Syracuse Street, Commerce City, CO  80022:  On and before November 13, 2017, the employer did not ensure that each employee was protected from falling through any hole that is 4 feet or more above a lower level.  Employees accessed an 8 foot high storage rack platform to move boxes of furniture.  The storage rack platform included a metal screen set in-between the metal racking, and this metal screen was not secured.  The storage rack platform did not have guardrail systems, and the employees were not using travel restraint or personal fall arrest systems.  When two employees accessed this platform, the metal screen shifted, and both employees fell 8 feet to the floor, resulting in serious injuries.  This condition exposed employees to a fall hazard of 8 feet.

Employees accessed an 8 foot high storage rack platform with an  unsecured platform base without the use of fall protection.  Employees accessed a mobile scaffold without adequate fall protection.  Employees were hoisted on pallets connected to forklift tines without the use of fall protection.  The employer did not adequately train employees on the nature of the fall hazards, the techniques to be following in minimizing these hazards, and the proper use of personal fall protection systems.  This condition exposed employees to a fall hazard of up to 10 feet.
