The employer did not ensure the following: a. The work was performed within a demarcated/regulated area; b. Access to regulated, demarcated areas was limited to authorized employees and persons authorized by the Act or regulations; c. All employees and persons entering the demarcated/regulated area wore respirators and that the respirators were selected in accordance with paragraph (h)(2), and; d. Employees were allowed to eat, drink, smoke, chew tobacco or gum, and/or apply makeup in the regulated/demarcated area.

The employer did not develope a program which would address labeling and other forms of warning on containers, safety data sheets and employee information and training on the hazards associated with asbestos. The written program must also contain the following: a. a list of all hazardous chemicals/materials onsite; b. the methods the employer will use to inform and train employees of the hazards of non-routine tasks and the known associated hazards; c. the hazards of chemicals/materials stored onsite, and; d. establish procedures to evaluate the effectiveness of the program.
