29 CFR 1910.1200(e)(1): The employer did not develop, implement, and maintain at each workplace, a written hazard communication program:  (a) Silverstreak Dairies, LLC at 14354 388th Avenue, Warner, SD 57479: On and prior to January 21, 2018 the employer did not ensure employees were protected from chemical hazards in that the company had not developed, implemented, and maintained a written hazard communication program at the Warner Dairy Site. Examples of chemicals used at this site include formalin, hydrogen peroxide, and sodium hypochlorite.  This condition exposed employees to chemical hazards.   Note: Per 29 CFR 1928.21(a)(5), standards in part 29 CFR 1910.1200 apply to agricultural operations.

29 CFR 1910.1200(f)(9): The employer did not ensure that labels or other forms of warning were legible and prominently displayed on the container:  (a) Silverstreak Dairies, LLC at 14354 388th Avenue, Warner, SD 57479: On and prior to January 21, 2018 the employer did not ensure employees were protected from chemical hazards in that the labels on containers of hazardous chemicals used in the dairy parlor were not maintained in a legible manner and not prominently displayed. This condition exposed employees to chemicals hazards.  Note: Per 29 CFR 1928.21(a)(5), standards in part 29 CFR 1910.1200 apply to agricultural operations.

29 CFR 1904.39(a)(2):  Within twenty-four (24) hours after the in-patient hospitalization as a result of a work-related incident, the employer did not report the in-patient hospitalization to OSHA:  (a) Silverstreak Dairies, LLC at 14354 388th Avenue, Warner, SD 57479: The employer did not report an in-patient hospitalization that occurred as a result of a workplace incident on January 21, 2018 at approximately 5:30 PM to OSHA within 24 hours. The in-patient hospitalization was reported to the Sioux Falls Area OSHA Office on January 24, 2018 at approximately 4:29 PM.
