OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees.   a) Underground Garage - On or about February 15, 2018, employees who were required to enter or exit through powered overhead steel doors, were exposed to entrapment and struck-by hazards as the doors closed.  These doors did not have safety devices such as safety edges or sensors.  Among other methods, one feasible and acceptable method of abatement is to comply with the International Building Code, 2015 Edition (adopted in full as the Building Code of New Castle by New Castle County, Delaware as legislated by Chapter 6 - BUILDING CODE, Sec. 6.04.001 of the New Castle County Code), Section 406.3.6, Automatic Garage Door Openers and ANSI/UL 325, Door, Drapery, Gate, Louver and Window Operators and Systems, Section 31, Commercial/Industrial Door Operators and Systems.

29 CFR 1910.305(b)(2)(i): Pull boxes, junction boxes, and fittings were not provided with covers approved for the purpose:    (a) Garage (electrical equipment mounted on the inside wall adjacent to Garage Door No. 7) - On or about February 15, 2018, the employer failed to cover an electrical junction box and an electrical outlet receptacle box each containing energized 120-volt screw cap-spliced wires, exposing employees to an electrical hazard.    Pursuant to 29 CFR 1903.19, the employer must submit abatement certification, required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
