29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift: (a) On or about 02/28/18, at the Charlotte Square Development Project, located at 78 Charlotte Street, in Rochester, New York, an employee installing exterior trim and siding, from a JLG articulating boom was not tied off. The boom basket platform was 14 feet above ground level. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: (a) On or about 02/28/18, at the Charlotte Square Development Project, located at 78 Charlotte Street, in Rochester, New York, a JLG aerial lift was not placed on a level surface while in use. The employer did not adhere to the warning labels installed on the boom basket to use the aerial lift on a level surface. NO ABATEMENT CERTIFICATION REQUIRED
