29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  a. On or about March 7, 2018, in the grinding area, the employer failed to developed or implemented a hearing conservation program for the protection of the employees who work grinding metal support brackets for stone countertops. Representative noise dosimetry showed that fabricators were exposed to TWA noise levels 91.6 dBA which exceeded the action level of an 8 hour time weighted average of 85 dBA.  b. On or about March 37 2018, in the grinding area, the employer failed to developed or implemented a hearing conservation program for the protection of the employees who work grinding metal support brackets for stone countertops. Representative noise dosimetry showed that fabricators were exposed to TWA noise levels 89.5 dBA which exceeded the action level of an 8 hour time weighted average of 85 dBA.

29 CFR 1910.133(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  a. On or about March 7, 2018, in the spray painting area, the employer failed to ensure that any employee conducting spray painting operations was wearing appropriate eye protection. The painter was observed not wearing eye protection from spray painting vapors and particles.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  a. On or about January 29, 2018, in the spray area, the employer failed to develop and implement those elements of a written program necessary to ensure that any employee required to use a respirator during spray painting operations was medically able to use that respirator and knew how to properly select, use, clean, maintain and store the respirator.
