29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).    On or about March 30, 2018, the employer did not ensure that powered industrial truck operators had been trained and evaluated prior to them operating the Caterpillar 90 diesel powered forklift, Yale diesel powered forklift, and the Kawasaki Z IV front end loader with forks to move materials and vehicles.

29 CFR 1910.178(q)(6): Industrial trucks shall not be altered so that the relative positions of the various parts are different from what they were when originally received from the manufacturer, nor shall they be altered either by the addition of extra parts not provided by the manufacturer or by the elimination of any parts, except as provided in paragraph (q)(12) of this section. Additional counterweighting of fork trucks shall not be done unless approved by the truck manufacturer.    On or about March 30, 3018, a Kawasaki Z IV front end loader and a Yale diesel powered forklift used to move materials and vehicles had their seatbelts removed from the operator stations.

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected.    On or about March 30, 2018, industrial trucks consisting of a Caterpillar 90 diesel powered forklift, Yale diesel powered forklift, and the Kawasaki Z IV front end loader with forks were not examined before being placed in service on a daily basis.

29 CFR 1910.252(a)(3)(i): Used containers. No welding, cutting, or other hot work shall be performed on used drums, barrels, tanks or other containers until they have been cleaned so thoroughly as to make absolutely certain that there are no flammable materials present or any substances such as greases, tars, acids, or other materials which when subjected to heat, might produce flammable or toxic vapors. Any pipe lines or connections to the drum or vessel shall be disconnected or blanked.    On or about March 22, 2018, an employee was instructed to utilize an oxygen-propylene torch to cut the top off 55 gallon metal drums.  The drums were not cleaned to ensure no flammable materials were present resulting in a drum exploding.

29 CFR 1910.252(b)(3): Protective clothing - General requirements. Employees exposed to the hazards created by welding, cutting, or brazing operations shall be protected by personal protective equipment in accordance with the requirements of 1910.132. Appropriate protective clothing required for any welding operation will vary with the size, nature and location of the work to be performed.    On or about March 22, 2018, the employer did not conduct a hazard assessment to determine the personal protective equipment required for employees engaged in oxygen-fuel gas torch cutting.
