29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person and were not constructed and loaded in accordance with that design.    A) Siebenaler Construction Company on or about April 20, 2018 at the address of 600 Independence Drive, Napoleon, OH: The employer did not ensure that the metal fabricated scaffolding platform attached to the Lull 844C fork truck was evaluated for load rating and distribution by a qualified person. Employees performing steel erection activities from this elevated platform were exposed to overturning and fall hazards from heights of 34 ft.

29 CFR 1926.453(b)(2)(v): A lanyard was not attached to the boom or basket when working from an aerial lift.    A) Siebenaler Construction Company on or about April 20, 2018 at the address of 600 Independence Drive, Napoleon, OH: The employer did not ensure employees had donned and secured personal fall arrest systems to a JLG Aerial Lift. Employees were exposed to a 30 foot fall while performing steel erection activities from the aforementioned aerial lift.

29 CFR 1926.760(a)(1): Except as provided by paragraph (a)(3) of this section, each employee engaged in a steel erection activity who was on a walking/working surface with an unprotected side or edge more than 15 feet (4.6m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems.    A) Siebenaler Construction Company on or about April 20, 2018, at the address of 600 independence Drive, Napoleon, OH: The employer did not ensure employees performing steel erection activities atop a commercial structure were adequately protected from falls. Employees performing edging, and fastening atop the structure were exposed to falls of 34 feet to the ground below.
