29 CFR 1910.145(f)(3): Tags were not used as a means to prevent accidental injury or illness to employees who were exposed to hazardous or potentially hazardous conditions, equipment or operations which were out of the ordinary, unexpected or not readily apparent. 02 Level, forward port side of USS Decatur: An accident prevention tag was not posted in the area to alert employees of the open hatch leading to the AUX 1 Emergency Escape Trunk below the deck. Employees were exposed to fall hazards of at least 40 feet.

29 CFR 1915.77(c): When employees are working aloft, or elsewhere at elevations more than 5 feet above a solid surface, the employer did not provide either scaffolds or a sloping ladder, meeting the requirements of this subpart, to afford safe footing, and the employees were not protected by safety belts and lifelines meeting the requirements of 1915.159 and 1915.160: 02 Level, forward port side of USS Decatur: During setup activities, employees had to step over an open hatch to access a fixed ladder to the 03 Level. Employees were exposed to fall hazards of at least 40 feet to the lower level.
