29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):    On or about 8/15/2018, during storm drain/sewer installation activities, located at 4507 West 213th St. Fairview Park, Ohio, the employer failed to ensure that employees were provided adequate cave in protection. An employee was down in the excavation without proper benching. The total depth of the excavation was about 7 feet in depth.  The excavation, measured at the top (or ground level), had an overall  length of 9 feet 6 inches, and a width of about 13 feet.    The unprotected portion of the excavation that was benched was approximately 6 feet 11 inches in length and width. Additionally a portion of the excavation had a bench that was approximately 4.5 feet in height from the bottom of the excavation, but was only benched back about 2 feet.
