29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: This violation occurred on September 18, 2018 when the employer did not develop and administer a hearing conservation program as described in 29 CFR 1910.95(c) through (o) for employees exposed to noise that exceeded an 8-hour time-weighted average (TWA) of 85 decibels. (a) A saw operator working on the Baker 2 headed resaw in the southwest corner of the production area was exposed to continuous noise levels at 154.7% of the permissible 8-hour time weighted average (TWA). The equivalent decibel (dBA) level of 154.7% is approximately 93.1 dBA. Sampling was performed for 510 minutes during one shift. The action level was adjusted from 85.0 dBA to 84.5 to account for the extended shift of more than 8 hours; (b) A pallet assembler working near the baker 2 headed resaw on the south east side of the production area was exposed to continuous noise levels at 300.1% of the permissible 8-hour time weighted average (TWA). The equivalent decibel (dBA) level of 300.1% is approximately 97.9 dBA. Sampling was performed for 504 minutes during one shift. The action level was adjusted from 85.0 dBA to 84.6 to account for the extended shift of more than 8 hours; (c) A saw operator working on the Baker notcher on the south side of the production area was exposed to continuous noise levels at 245.4% of the permissible 8-hour time weighted average (TWA). The equivalent decibel (dBA) level of 245.4% is approximately 96.4 dBA. Sampling was performed for 455 minutes during one shift. Zero exposure was assumed for the 25 minutes not sampled; (d) A saw operator working on the Baker 2 headed resaw on the north side of the production area was exposed to continuous noise levels at 191.3% of the permissible 8-hour time weighted average (TWA). The equivalent decibel (dBA) level of 191.3% is approximately 94.6 dBA. Sampling was performed for 481 minutes during one shift. The action level was adjusted from 85.0 dBA to 85.0 to account for the extended shift of more than 8 hours; (e) A saw operator working on the Newman KM-16 trim saw in the north west corner of the production area was exposed to continuous noise levels at 217.4% of the permissible 8-hour time weighted average (TWA). The equivalent decibel (dBA) level of 217.4% is approximately 95.6 dBA. Sampling was performed for 480 minutes during one shift; (f) A saw operator working on the Baker 3 headed band resaw on the south side of the production area was exposed to continuous noise levels at 219.5% of the permissible 8-hour time weighted average (TWA). The equivalent decibel (dBA) level of 219.5% is approximately 95.6 dBA. Sampling was performed for 431 minutes during one shift. Zero exposure was assumed for the 49 minutes not sampled; (g) A saw operator working on the Newman KM-16 trim saw in the southwest corner of the production area was exposed to continuous noise levels at 165.4% of the permissible 8-hour time weighted average (TWA). The equivalent decibel (dBA) level of 165.4% is approximately 93.6 dBA. Sampling was performed for 480 minutes during one shift; (h) A pallet assembler working in the south east portion of the production area was exposed to continuous noise levels at 284.9% of the permissible 8-hour time weighted average (TWA). The equivalent decibel (dBA) level of 284.9% is approximately 97.5 dBA. Sampling was performed for 416 minutes during one shift. Zero exposure was assumed for the 64 minutes not sampled; (i) A pallet assembler working near the time clock was exposed to continuous noise levels at 505.0% of the permissible 8-hour time weighted average (TWA). The equivalent decibel (dBA) level of 505.0% is approximately 101.6 dBA. Sampling was performed for 420 minutes during one shift. Zero exposure was assumed for the 60 minutes not sampled; (j) A forklift driver was exposed to continuous noise levels at 96.47% of the permissible 8-hour time weighted average (TWA). The equivalent decibel (dBA) level of 96.47% is approximately 89.7 dBA. Sampling was performed for 461 minutes during one shift. Zero exposure was assumed for the 19 minutes not sampled.
