OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:  (a) on or about 08/14/2018 two workers were exposed to crushing injuries from a forklift rollover accident because they were not wearing a seatbelt while operating a forklift.  The Letter of Interpretation dated October 9, 1996 addresses this condition and references ASME B56.1 consensus standards for power industrial trucks. The manufacturers of this equipment has supplied seat belts. One method of abatement is for the employer to ensure employee(s) always wear seat belts while operating the Power Industrial Trucks (forklifts) and that the employer follows ASME/ANSI 56.1a-1989 Addenda to ASME/ANSI B56.1-1988; and ASME B56.1-1993.

(b) on or about 08/14/2018 employees operating a Hyster forklift, or who were near the operation it, were exposed to struck by hazards in that the forklift was missing an instructional marking on a control lever knob.

29 CFR 1917.112(c)(2): Guardrails which were not of solid baluster, or similar construction, did not consist of top rails and mid-rails:  (a) on or about 08/14/2018 employees working on the bridge leading to the floating dock were exposed to fall hazards in that a protective wall on the east side of the bridge did not contain a mid rail, and the uprights were more than 20" apart.  (b) on or about 08/14/2018 employees working on the bridge leading to the floating dock were exposed to fall hazards in that a protective wall on the west side of the bridge did not contain a mid rail or a top rail, and the uprights were more than 20" apart.
