29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:    (a)  On or about September 6, 2018, and at times prior, Fortenberry & Ricks, LLC, as controlling, correcting, and exposing employer, did not ensure its employees and employees of Elite Welding, subcontractor, were protected from fall hazards at the following locations:  - into the mechanical shafts to the east of the "screen porch;" the mechanical shafts were 14 feet deep;  - into the stair well at the north end of the "screen porch;"  the stair well was 12 feet deep; and  - off of the south end at the west corner of the "screen porch;" the fall hazard was greater than 6 feet.      Abatement Note:  Abatement certification is required for this item (see the enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.501(b)(4)(ii): Each employee on a walking/working surface was not protected from tripping in or stepping into or through holes, by covers:    (a)  On or about September 6, 2018, and at times prior, Fortenberry & Ricks, LLC, as controlling, correcting, and exposing employer, did not ensure that its employees and the employees of Elite Welding, subcontractor, were protected from injuries from tripping in or stepping into rectangular floor holes on the concrete deck on the west side of the building under construction.  Although large holes were covered, the smaller holes between the larger ones, had no covers.  The uncovered holes were greater than 2 inches wide in their least dimensions.     Abatement Note:  Abatement certification is required for this item (see the enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.502(i)(4): All covers were not color coded or marked with the word "HOLE" or "COVER" to provide warning of the hazard:  (a)  On or about September 6, 2018, and at times prior, Fortenberry & Ricks, LLC, as controlling, exposing and conrrecting employer, did not ensure that its employees and the employees of of Elite Welding, subcontractor, were protected from floor holes in that the floor holes that were covered were not marked to indicate the presence of a hole. 29 CFR 1926.1052(c)(1): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with at least one handrail and one stairrail system along each unprotected side or edge:  (a)  On or about September 6, 2018, and at times prior, Fortenberry & Ricks, LLC, as controlling, correcting, and exposing employer, did not ensure that its employees and employees of Elite Welding, subcontractor, were protected from fall hazards on the temporary stairway erected to access the "screen porch" area.  The stairway did not have hand rails or a stairrail system along each side.  The stairway had four risers and rose 35 inches.    Abatement Note:  Abatement certification is required for this item (see the enclosed, "Certification of Corrective Action Worksheet").

29 CFR 1926.701(b): All protruding reinforcing steel, onto and/or into which employees could fall, was not guarded to eliminate the hazard of impalement:      (a)  On or about September 6, 2018, Fortenberry & Ricks, LLC, as controlling, correcting, and exposing employer, did not ensure that its employees and the employees of Elite Welding, were protected from impalement hazards on uncapped rebar while working on the deck on the west side of the building under construction.  The uncapped rebar was at the edges of the deck, and in the mechanical shafts.        Abatement Note:  Abatement certification is required for this item (see the enclosed, "Certification of Corrective Action Worksheet").
