In accordance with 29 CFR 1903.19, abatement certification is not required for this violation as the hazardous condition was corrected during the inspection.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.  a) Commercial Establishment, 240 Wilkes-Barre Boulevard, Wilkes-Barre Township, PA - Employees used a 28-foot Type IA Fiberglass D-Rung Extension Ladder - Model D6228-2 for roof access/egress with fly section side rails that extended twenty (20) inches above the roof edge exposing the employees to a fall hazard, as observed on or about October 12, 2018.  In accordance with 29 CFR 1903.19, abatement certification is not required for this violation as the hazardous condition was corrected during the inspection.
