29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: On or about October 24, 2018, the employer did not conduct adequate safety inspections prior to employees working in an excavation. Complete soil testing and classification was not conducted, spoil piles were not set-back at least two (2) feet from the wall, and required cave-in protection was not utilized.
