29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.     The employer is failing to ensure that all employees exposed to fall hazards while working on a commercial roof are utilizing fall protection.  This most recently occurred on November 8, 2018 on the jobsite located at 7007 Oak St, Omaha, NE 68106.  Two employees were observed setting a wall panel on the third floor a newly constructed commercial building where the ground to eave height was greater than 6 feet.  Employees were not utilizing any form of fall protection.

29 CFR 1904.33(a): The OSHA 300 Log, the privacy case list (if one exists), the annual summary, and the OSHA 301 Incident Report forms were not saved for five (5) years following the end of the calendar year that these records covered.     The employer is failing to ensure that at least five years of the OSHA 300A annual summary are kept.  This was most recently evident during an inspection conducted on November 8, 2018 on the jobsite located at 7007 Oak St, Omaha, NE 68106.  When the OSHA 300 Logs and 300A Summary were requested as part of the inspection the employer was not able to produce the 300A for 2014.
