29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)(a)(LOCATION)(IDENTIFY CHEMICAL/PRODUCT(S) AND DEFICIENCY):  (a)  Construction site - On or about December 13, 2018 employee used/was exposed to chemical products, such as but not limited to, off road diesel and the employer did not have a written hazard communication program.

29 CFR 1910.1200(f)(6)(i): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the information required by 29 CFR 1910.1200(f)(1)(i) through 29 CFR 1910.1200(f)(1)(v):  (a)  Construction site - On or about December 13, 2018 fueling tank containing diesel mounted in bed of company pick-up truck was not labeled as required.
