29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.    a). At the worksite - On or about January 17, 2019, a Werner portable extension ladder (model: D1216-2) did not have its side rails extended at least three (3) feet above the landing surface (i.e. roof), thus exposing an employee to a fall hazard of approximately 9 feet.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired.  a). At the worksite - On or about January 17, 2019, employees used a Werner portable extension ladder (model: D1216-2) that had a damaged side rail, thus exposing employees to a fall hazard of approximately 9 feet.
