29 CFR 1910.147(c)(4)(ii)(D): The energy control procedures did not clearly and specifically outline the requirements for testing a machine or equipment to determine and verify the effectiveness of lockout devices, tagout devices, and other energy control(s):  On or about 01/22/2019, Tops Unlimited, Inc., located at 700 Biltmore Drive, Fenton, MO, did not have specific requirements for testing a machine or equipment to determine and verify the effectiveness of lockout devices, tagout devices, and other energy control measures.  The employer had the following equipment:  A Biesse saw, (Model Selco SK 4, S/N: 1000018171) with electric, pneumatic, and potential (gravity) energy sources; A Biesse CNC (Model: Skill 15.36G FT, S/N: 1000003239) with electric and pneumatic energy sources; and A Northtech Industrial Machine (Model: NT-KL-36C-A, S/N: 080125) with electric and pneumatic energy sources.

29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years:   On or about 01/22/2019, Tops Unlimited, Inc., located at 700 Biltmore Drive, Fenton, MO, had not ensured that each powered industrial truck (forklift) operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the reevaluation/training.  It was reported that some of the training and evaluations were approximately 10 years ago.

29 CFR 1910.147(c)(5)(ii)(D): Lockout devices and tagout devices did not indicate the identity of the employee applying the device(s):  On or about 01/22/2019, Tops Unlimited, Inc., located at 700 Biltmore Drive, Fenton, MO, did not provide or ensure lockout and tagout devices indicated the identity of the employee applying the devices.  During the inspection, the Northtech Industrial Machine was locked out with a general lock that various management personnel would use.  There was no identity of who had locked out the equipment.
