29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:    (a) On April 30, 2019, and on dates prior, the employer did not verify that elements of a written respiratory protection program were in place to ensure that any employee using a respirator voluntarily is medically able to use that respirator. Employees used half-face elastomeric respirators voluntarily without being initially cleared to use a tight-fitting elastomeric respirator by a Physician or Other Licensed Health Care Professional.

29 CFR 1910.1026(d)(1): The employer with a workplace or work operation covered by this standard did not determine the 8-hour time-weighted average exposure for each employee exposed to chromium (VI):  (a) On April 18, 2019, in the SHOP area located at W126N8585 Westbrook Crossing, Menomonee Falls, WI 53051, where workers were using carbon steel welding wire with varying compositions of chromium, a welder was exposed to hexavalent chromium at an 8-hour time weighted average of 0.192 micrograms per cubic meter while using a chromium containing welding wire. The sample was collected during a 460 minute sampling period and exposure calculations include a zero increment for the 20 minutes not sampled.  The employer is to make this determination in accordance with either paragraph (d)(2), the scheduled monitoring option, or paragraph (d)(3), the performance-oriented option.
