OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crush-by hazards:  a) On or about February 27, 2019; employees operated the MOFFETT-M50P (S/N: F270038) diesel-truck mounted forklift without a seat belt installed, exposing employees to entrapment between the truck and ground in the event of a tip-over.  b) On or about February 27, 2019, the MOFFETT-M50P (S/N: F270038) diesel-truck mounted forklift used for the delivery of construction materials, had the seat belt interlocking system disengaged, exposing employees to an entrapment hazard in the event of a tip-over.
