A stairway, ladder, ramp or other safe means of egress was not located in trench excavations more than 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees:     (a) On March 28, 2019, for the employee exposed to cave-in and struck-by hazards while locating a leaking pipe in an excavation approximately 5 feet 6 inches in depth where no ladder or other safe means of egress was used in the vicinity of 3400 North Broadway in Fargo, North Dakota.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety:     (a) On March 28, 2019, for the employees exposed to cave-in and struck-by hazards while locating a leaking pipe in an excavation approximately 5 feet 6 inches in depth where no protective systems and safe means of egress were used in the vicinity of 3400 North Broadway in Fargo, North Dakota.       Note:  This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1172162, Citation 1, Item 1a, and was affirmed as a final order on 10-31-16, with respect to a workplace located at the vicinity of 35th Street and 36th Avenue, West Fargo, North Dakota.
