29 CFR 1926.1408(a)(2)(iii)(B): The employer did not ensure that: Employer will determine if any part of the (crane) equipment, load line or load (including rigging and lifting accessories), while operating up to the equipment's maximum working radius in the work zone, could get closer than the minimum approach distance of the power line permitted under Table A (see � 1926.1408). If so, then the employer must follow the requirements in paragraph (b) of this section to ensure that no part of the equipment, load line, or load (including rigging and lifting accessories), gets closer to the line than the minimum approach distance. a) The knuckleboom crane was being operated within 5 feet of the energized 240v overhead powerline that feeds temp power to the construction site; the crane operator and employees assisting the crane lift were exposed to electrocution hazard. Location: 855 60th Street, Brooklyn NY On or about 6/21/2019 NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.

29 CFR 1926.1408(b)(1): When the employer was aware that the parts of the crane equipment, rigging and lifting accessories may get closer than the minimum approach distance of the power line permitted under Table A (see � 1926.1408) the employer did not conduct a planning meeting with the operator and the other workers who will be in the area of the equipment or load to review the location of the power line(s), and the steps that will be implemented to prevent encroachment/electrocution. a) The employer did not conduct a crane planning meeting to ensure the crane will stay a minimum of 10 feet from the energized powerlines which were in the work area; the crane was being operated within 5 feet of the overhead 240v energized powerline. The crane operator and other employees assisting the crane lift were exposed to electric shock hazard.
