29 CFR 1926.1053(b)(1): Where a portable ladder(s) was used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder. (a) On or about July 03, 2019, the portable Little Giant ladder erected on the East side of the Structure, and being used for access to the form work, did not extend at least three (3) feet above the edge, and/or was not secured to the structure when it was not sufficiently extended.

Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. (a) On or about July 03, 2019, employee(s) engaged in concrete work while standing on the top of the 2nd floor level concrete forms were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately Thirteen (13) feet six (6) inches at the front of the structure and approximately twenty-four (24) feet at the rear of the structure.
