29 CFR 1910.1030(c)(1)(ii): The employer's Exposure Control Plan did not contain at least the elements in 29 CFR 1910.1030(c)(1)(ii)(A) through (c)(1)(ii)(C): (a) On July 10, 2019, and at times prior, the employer exposed employees to contact with biological substances in that the employer failed to properly establish a complete, written exposure control plan as employees performed dental procedures on patients. The employer's written program did not contain all of the required elements including, but not limited to, the schedule of implementation, the methods for communicating hazards to employees, annual consideration of safer medical devices, and input from exposed, non-managerial employees in the consideration of engineering and work practice controls.

The training that was provided did not include an explanation of the employer's exposure control plan, the means of obtaining a copy of the written plan, or a general explanation of the symptoms of blood borne diseases.
