(i) Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following: (A) Guardrail system; a) On or about July 11, 2019 employees were exposed to fall hazards while on top of the overheard storage area in the warehouse, in that a guard railing system was not in place, exposing employees to fall hazards in excess of nine (9) feet.

29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition. a) The Yale powered industrial lift truck was not removed from service when defects were found in that the gas pedal sticks, brakes grabs are intermittent sometime they grab hard; then other times it takes awhile to stop and the back up alarm does not work.
