29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) Worksite: Employees working on an unprotected side of a cat walk approximately 10 ft. above ground levels were not using adequate fall protection. The employees were assembling a material handling system in the warehouse on or about 7/16/19. ABATEMENT VERIFICATION IS NOT REQUIRED PURSUANT TO 29 CFR 1903.19.

29 CFR 1926.503(c): The employer did not retrain affected employees who already had been trained but demonstrated inadequate understanding and skill required by paragraph (a) of this section: Note: Circumstances where retraining is required include, but are not limited to, situations where (1) Changes in the workplace render previous training obsolete; or (2) Changes in the types of fall protection systems or equipment to be used render previous training obsoleted; or (3) inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retrained the requisite understanding or skill: a) Worksite: Employees installing/ assembling a material handling system on a cat walk approximately 10 ft. above ground floor were not using adequate fall protection. The employees who were already trained but demonstrated inadequate understanding and skill were not retrained. on or about 6/7/19. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.
