29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person: (a)Big Al's Contracting LLC at South Elm Street, Central Basin 2 Project, Lennox, SD 57039: On or about and at time prior to July 29, 2019, the exposing employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees were working in an excavation that had unsupported walls, exposed rebar and unsupported gas lines. These conditions exposed employees to hazards related to cave-in, impalement and fire and explosion. Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: (a)Big Al's Contracting LLC at South Elm Street, Central Basin 2 Project, Lennox, SD 57039: On or about and at time prior to July 29, 2019, the exposing employer did not ensure employees were instructed in the recognition and avoidance of unsafe conditions related to working in excavations without a protective system. Employees were involved in box inlet installation within trench excavations. The employer did not instruct employees in effectively evaluating the hazards related to working in excavations and protective systems regarding sloping, benching or trench boxes to ensure employees were protected within excavations deeper than five feet. These conditions exposed employees to cave-in hazards as a result of working in an excavation with vertical unsupported walls over five feet.

Employees were installing box inlets in an excavation approximately seven feet in depth which lacked an adequate protective system, such as sloping, benching, or shielding system. This condition exposed employees to cave-in hazards within an excavation seven feet deep.

This condition exposed employees to an impalement hazard.
