29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):  (a)  Horizon Roofing Inc, at 562 Main Street, Minturn, CO: On 8/16/19, the employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them).  Employees were roofing a multi-story multi-family residential structure.  Two employees were not protected from a fall while working on the building roof.  The employees accessed the roof top using a tubular metal scaffold.  The employer did not ensure that the work site was inspected by a competent person.  This condition exposed the employees to an approximate 36 foot fall hazard.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or another provision in paragraph (b) of this section which provides for an alternative fall protection measure:  (a)  Horizon Roofing Inc, at 562 Main Street, Minturn, CO: On 8/16/19, the employer did not ensure that each employee engaged in residential construction activities 6 feet or more above lower levels was protected by guardrail systems, safety net systems, personal fall arrest systems, or another provision in paragraph (b) of this section which provides for an alternative fall protection measure.  Employees were roofing a multi-story multi-family residential structure.  Two employees were not protected from a fall while working on the building roof.  The employer did not ensure that all employees were protected by guardrail systems, safety net systems, or personal fall arrest systems.  This condition exposed the employees to an approximate 36 foot fall hazard.
